Debunking Common Myths About Child Support In Texas

  • By: Christina Perrone, Esq.
Caring mother hugging and calming upset daughter – child support myths in Texas

In this article, you will discover:

  • Whether only fathers can be ordered to pay child support
  • The exception to the rule that child support in Texas stops when the child turns 18
  • Whether a Texas parent can cease child support payments when their ex-spouse remarries

Myth #1: Only Fathers Have To Pay Child Support In Texas

Any parent, mother or father, can be ordered to pay child support.

Myth #2: Child Support In Texas Automatically Stops When A Child Turns 18

There are exceptions to this rule. A child support order can allow for child support to go through high school graduation, college, or even adulthood for a disabled child.

Myth #3: A Texas Parent Can Stop Paying Child Support If Their Ex-Spouse Remarries Or Has A New Partner

This circumstance is not commonly a basis for ceasing child support.

Myth #4: Is It Illegal For A Texas Parent To Misuse Child Support Payments Intended For Their Child’s Needs

There are no specific court orders about how the child support funds must be spent. Usually, a parent receiving the child support has the exclusive right to disperse those funds as they see fit.

Myth #5: If You Have More Children, The Court Will Not Reduce Child Support

The birth of a child that is not part of the court order for child support is, in fact, grounds to modify the order and ask for a reduction.

Case Study: A Case Where A Parent’s Misunderstanding Led To Legal Trouble For Them

I previously represented a client who believed that his child support payments could be earmarked for specific costs related to the child.

Specifically, he believed that instead of paying support through the Child Support Disbursement Unit, he could instead pay specific expenses in an amount totaling his support obligation. This tactic is not permitted. You cannot control how the money paid as support is spent, so do not try.
